Welcome to NeonPets (“NeonPets”, “we”, “us”, “our”). These Terms of Service (“Terms”) govern your use of neonpets.example (the “Site”), our store, and all related services (collectively, the “Service”). By accessing the Site, creating an account, or placing an order you agree to these Terms. If you do not agree, do not use the Service.

Important: NeonPets is an independent online shop and is not affiliated with, sponsored by, or endorsed by Roblox Corporation, Uplift Games, Adopt Me, or any other third-party developer, platform, or publisher. All third-party trademarks and intellectual property remain the property of their respective owners.

1. Eligibility

You must be at least 13 years old to use the Site. If you are under the age of majority in your jurisdiction, a parent or guardian must agree to these Terms on your behalf. By using the Service you represent and warrant that you meet the eligibility requirements.

2. Account & Order Information

To place an order you may be required to provide contact, billing, and delivery information (for example, your in-game username and a valid payment method). You warrant that information you provide is accurate and complete. You are responsible for maintaining the confidentiality of any credentials or account details. Notify us promptly if you suspect unauthorized access to your account.

3. Our Products & Delivery

NeonPets sells digital in-game items (the “Items”).

Nature of goods: All Items are digital and delivered via in-game trading mechanisms or other electronic delivery methods described at checkout.
Delivery speed: Delivery is typically instant or within a few minutes of order confirmation. Delivery timing may vary with operational load; if you experience issues our support team will assist.
How delivery works: You must provide correct delivery details (e.g., in-game username) and follow any instructions we provide at checkout to receive your Items.

4. Pricing, Payments & Taxes

Displayed prices: Prices shown on the Site or at checkout may change at any time without prior notice.
Payment authorization: By placing an order you authorize NeonPets (and our payment processor) to charge your selected payment method for the full amount shown at checkout.
Currency processing: Although prices may be displayed in your local currency for convenience, all orders are processed in USD unless we explicitly state otherwise at checkout. Your bank or payment provider may apply exchange rates and conversion fees; those charges are outside NeonPets’ control.
Taxes & fees: Applicable taxes (sales tax, VAT, or other governmental charges) will be calculated and displayed at checkout. You are responsible for any customs, import, or local taxes that apply.
Processor fees & currency risk: NeonPets is not responsible for foreign exchange spreads, bank fees, or other charges applied by your payment provider.

Industry practice: merchants clearly state currency and who bears conversion/processing fees to reduce disputes.

5. Refunds, Cancellations & Unclaimed Orders

NeonPets maintains a separate Refund Policy page linked from the Site. Key rules:

Requesting refunds: You may request a refund any time before you claim the order (i.e., before the Item is delivered/accepted).
Automatic refunds for unclaimed orders: If an order is not claimed within 48 hours, NeonPets will automatically refund the purchase amount.
After claims/delivery: Once an Item is delivered and successfully claimed, refunds are generally not available, except where required by law or under exceptional circumstances we expressly accept.
Cancellations: Orders may be cancelled before delivery at our discretion; any refunds follow the Refund Policy terms and payment processor rules.
Chargebacks: Filing a chargeback after a successful delivery will be treated as potential fraud. NeonPets will respond to payment processors with delivery logs, timestamps, and evidence. Repeated or fraudulent chargeback activity may result in account action.

6. Fraud Prevention & Security

We take fraud seriously. NeonPets reserves the right to:

Cancel or pause orders that appear fraudulent or suspicious;
Request verification of identity or payment information before fulfilling an order;
Refuse service to customers involved in chargeback abuse, fraud, or other malicious activity.

We log trades and delivery attempts for security and dispute resolution.

7. Site Rules & Prohibited Activities

You may only use the Site as allowed by these Terms. The following activities are expressly prohibited:

Systematically retrieving Site content to create a separate database or directory without written permission.
Attempting to trick, defraud, or mislead NeonPets or other users.
Circumventing, disabling, or otherwise interfering with security features of the Site.
Disparaging or harming NeonPets’ reputation.
Harassing, abusing, or threatening our staff or other users.
Misusing support channels or submitting false abuse reports.
Uploading malware, viruses, or any disruptive code.
Using bots, scrapers, spiders, or automated tools to interact with the Site (except standard search engine crawlers).
Impersonating other users or staff, or creating accounts under false pretenses.
Reverse engineering, decompiling, or modifying Site code or software components.
Collecting users’ personal data for unsolicited contact or commercial use without consent.
Using the Site to compete with NeonPets or for unauthorized commercial exploitation.
Selling or transferring your NeonPets profile.

Violations may result in order refusal, account suspension, cancellation of transactions, or legal action.

8. Errors, Inaccuracies & Omissions

Occasionally the Site may contain typographical errors, inaccuracies, or omissions in product descriptions, pricing, promotions, availability, or delivery details. NeonPets reserves the right to correct, update, or remove such information, and to cancel or refuse any order where a material error exists, even after you submit an order. We will make reasonable efforts to notify affected customers and either fulfill the corrected order or issue a refund according to Section 5.

9. Intellectual Property

All Site content (design, text, graphics, logos) is owned or licensed by NeonPets and protected by copyright, trademark and other intellectual property laws. You may not use NeonPets’ trademarks or copyrighted materials without our prior written consent. Use of third-party names and marks on the Site is for identification only and belongs to their respective owners.

10. User Content & Communications

When you submit content (messages, feedback, or support requests), you grant NeonPets a worldwide, royalty-free license to use, copy, modify, publish and display such content for the purposes of operating and improving the Service. NeonPets may remove or refuse content that violates these Terms.

11. Disclaimers

The Site and Services are provided “as is” and “as available.” To the fullest extent permitted by applicable law, NeonPets disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. NeonPets does not guarantee that the Site will be uninterrupted, secure, or error-free.

12. Limitation of Liability

To the maximum extent permitted by law, NeonPets’ total aggregate liability arising out of or related to these Terms or your use of the Service shall not exceed the amount you paid NeonPets for the specific order giving rise to the claim. In no event will NeonPets be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits or loss of data, even if NeonPets has been advised of the possibility of such damages.

13. Indemnification

You agree to indemnify, defend and hold harmless NeonPets, its officers, directors, employees and agents from and against any claims, losses, damages, liabilities, including legal fees and expenses, arising out of your breach of these Terms or your use of the Site, including violation of third-party rights or applicable laws.

14. Changes to the Service & These Terms

NeonPets may modify or discontinue the Site or Services (or any part) at any time without notice. We may also update these Terms; material changes will be reflected by a revised “Last updated” date and, where appropriate, notification on the Site. Continued use after changes constitutes acceptance of the updated Terms.

15. Governing Law & Dispute Resolution

These Terms are governed by the laws of the jurisdiction where NeonPets is established. Any disputes arising under or related to these Terms will be subject to the exclusive jurisdiction of the courts in that jurisdiction, unless otherwise required by law.

16. Final Provisions

No legal/tax advice: Nothing in these Terms is legal, tax, or financial advice. Consult your own advisors for such matters.

No waiver: NeonPets’ failure or delay to exercise any right does not constitute a waiver.
